V360 TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Voice 360’s websites voice-360.com (the “Sales Site”) and members.voice-360.com (the “Member Site”), together with any related content, products, features, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1) Eligibility & Accounts
You must be 18+ to create and manage an account. Parents/guardians may allow their child to access content under the parent-managed account. Children may not self‑register.
You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Accounts are for personal, household use by the purchasing family only. Device & stream limits: up to 3 registered devices per household account and 1 concurrent stream at a time. We may require device re‑verification from time to time.
We may monitor for unusual login activity and suspend accounts for suspected sharing or abuse.
Platform security: We require multi‑factor authentication (MFA) for staff/admin access to production systems. (This is internal and does not require MFA from customers.)
2) Privacy
Your use of the Service is subject to our Privacy Policy (incorporated by reference). Please review it to understand how we collect, use, and safeguard information. Contact: info@voice-360.com.
3) Memberships, Trials, Renewals & Billing
a) Plans
We offer subscription plans (e.g., 1‑month, 3‑month, 6‑month). Current plan details and pricing appear at checkout.
b) Free trials (if offered)
Trial eligibility, length, and included features are disclosed at sign‑up.
Unless you cancel before the trial ends, your paid plan begins automatically and we will charge the payment method on file.
One trial per household unless we state otherwise.
c) Recurring billing & taxes
Recurring: Subscriptions renew automatically at the end of each term until canceled.
When billed: On renewal date for your chosen term.
Taxes: Applicable taxes may be added where required by law.
d) Price or plan changes
We may change pricing or plan features prospectively. If we change your recurring price or materially change benefits, we’ll notify you in advance and the change will apply on your next renewal. If you don’t agree, cancel before renewal.
e) How to cancel
You can cancel any time before renewal from your account settings (Member Site) or by emailing info@voice-360.com. Cancellation takes effect at the end of the current paid term; no refunds or credits for partial periods unless required by law.
f) Refund policy
We offer a 3‑day refund from purchase for first‑time orders. Request at info@voice-360.com. After 3 days, payments are non‑refundable, except where required by law.
Exceptions we may honor at our discretion:
Duplicate purchase of the same plan within 24 hours
Accidental renewal reported within 24 hours
Documented technical failure on our side that materially prevented access or use (and not resolved within a reasonable time after you reported it)
g) Failed payments; chargebacks
If a payment fails, we may retry the charge and/or suspend access until resolved. Unfounded chargebacks may result in account suspension and fee recovery to the extent permitted by law.
h) Gift codes, promotions, coupons
Unless otherwise stated, promotions and coupons: (i) are one‑time use; (ii) have no cash value; (iii) cannot be combined; and (iv) may be subject to additional terms.
i) Compliance with auto‑renewal laws
Where required, we provide clear renewal terms at sign‑up and advance emails before renewals. For automatically renewing subscriptions purchased directly from V360 (including 1‑, 3‑, and 6‑month plans), we send pre‑renewal reminders approximately 7 days and 1 day before renewal to the email on file. You are responsible for keeping your contact information current and for safelisting our emails so you receive notices. Cancellation methods are at least as easy as sign‑up.
ESA note: ESA‑funded prepaid fixed‑term memberships (e.g., 12‑month ESA purchases) do not automatically renew and are excluded from pre‑renewal reminders.
j) Scholarship/ESA‑Funded Purchases (Step Up for Students, ClassWallet, Odyssey, etc.)
Non‑refundable fixed terms. ESA‑funded prepaid fixed‑term memberships (e.g., 12 months) are non‑refundable once access begins. You may cancel early to stop future access, but no prorated refunds are provided unless required by the applicable ESA program or by law.
Refund destination. If a refund is permitted or required for an ESA‑funded purchase, funds will be credited back to the student’s ESA account through the applicable platform (e.g., EMA/MyScholarShop, ClassWallet, Odyssey). No refunds to personal payment methods.
Program rules control. If these Terms conflict with an ESA program’s rules (including refund handling or timing), the program’s rules govern for ESA‑funded transactions.
No automatic renewal (ESA). ESA‑funded prepaid fixed‑term memberships do not auto‑renew. To continue after the term ends, you must make a new ESA‑funded purchase (subject to program approval and available funding).
3‑day refund policy inapplicable. Notwithstanding Section 3(f), the 3‑day refund window and the discretionary exceptions do not apply to ESA‑funded purchases, except where the applicable ESA program expressly requires a refund to the ESA account.
4) Permitted Use & Restrictions
You may stream and use lesson videos, worksheets, and quizzes for your personal, non‑commercial use while your subscription is active.
Downloadables: Worksheets/printables provided for download are licensed for personal, household use only. Redistribution, classroom sharing, posting, or resale is prohibited without prior written permission from Voice 360.
Device/stream limits: Up to 3 registered devices per household account and 1 concurrent stream at a time. Use of VPNs, proxying, or other methods to bypass these limits is prohibited.
You may not: copy, download, record, rebroadcast, mirror, or distribute streaming content; remove notices; bypass access controls; scrape; use bots; or otherwise misuse the Service.
Do not upload, transmit, or introduce malware or harmful code, or attempt to probe, scan, or test system vulnerabilities.
5) Educational & Wellness Disclaimers (No Medical Advice)
The Service provides educational content about singing and voice use. It does not provide medical advice and is not a substitute for evaluation or care by a qualified clinician. Stop any activity that causes pain or distress and consult a clinician if needed. You are responsible for your or your child’s use of the Service.
6) User Content & Messaging
The Service may allow private messaging with an instructor. We do not operate public forums.
You retain ownership of content you submit (“User Content”). You grant us a non‑exclusive, worldwide, royalty‑free license to host, process, and display User Content solely to operate the Service and support you (e.g., support tickets, teacher communication).
You represent you have the rights to submit User Content, and that it will not be unlawful, infringing, or harmful. We may remove User Content that violates these Terms.
We do not require audio/video uploads and do not record live sessions. Please avoid sharing children’s personal information in messages.
7) Intellectual Property
All lesson videos, worksheets, quizzes, text, graphics, and other materials are owned by Voice 360 or its licensors and are protected by IP laws. We grant you a limited, revocable, non‑transferable license to access the content for personal, non‑commercial use during your active subscription. All rights not expressly granted are reserved.
8) Third‑Party Services
We use third‑party providers (e.g., Stripe for payments; MemberPress/BuddyBoss for membership features; Hostinger/QUIC.cloud/LiteSpeed for hosting/caching; Mailchimp for email). Their terms and privacy practices apply to their services. We are not responsible for third‑party sites or services.
9) Service Changes; Availability
We may modify, suspend, or discontinue any part of the Service (including specific courses or features) with reasonable notice where practicable. We are not liable for outages or delays outside our control (e.g., internet, hosting, or third‑party downtime).
10) Termination
We may suspend or terminate your account for breach of these Terms, fraud, illegal activity, or to protect the Service or users. You may cancel at any time per Section 3(e). Upon termination or expiration, your right to access the Service ends, and licenses granted to you cease.
11) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Voice 360 and its affiliates, officers, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.
12) Warranties; Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. We do not guarantee uninterrupted or error‑free operation.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICE 360 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO VOICE 360 FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR $50 IF GREATER WHERE REQUIRED BY LAW). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14) Dispute Resolution; Arbitration; No Class Actions
Please read this section carefully. It affects your rights.
Good‑faith resolution. Contact info@voice-360.com and we will try to resolve your concern.
Binding arbitration. Except for claims that may be brought in small‑claims court and requests for temporary or injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration under the Commercial (or Consumer, where applicable) Rules of the American Arbitration Association (AAA). The arbitration will take place in Palm Beach County, Florida, or remotely by agreement, before a single arbitrator.
No class actions. You agree to arbitrate individually and not participate in class, collective, or representative actions. The arbitrator may award relief only in favor of the individual party seeking relief.
Opt‑out. You may opt out of arbitration within 30 days after you first agree to these Terms by sending an email to info@voice-360.com with the subject “Arbitration Opt‑Out” and your account email and name.
Court for injunctive relief/award entry. Either party may seek injunctive relief in court to protect IP or confidential information or to confirm/enforce an arbitration award in a court of competent jurisdiction in Palm Beach County, Florida.
15) Governing Law
Florida law governs these Terms and any disputes, without regard to conflict‑of‑laws principles, except that the FAA governs arbitration issues.
16) DMCA; Copyright Complaints
If you believe content on the Service infringes your copyright, please send a notice with: (1) your physical/electronic signature; (2) identification of the work; (3) identification of the allegedly infringing material and its location; (4) your contact information; (5) a statement of good‑faith belief; and (6) a statement under penalty of perjury of accuracy and authority. Send to info@voice-360.com with subject “DMCA Notice.”
17) Changes to the Service or to These Terms
We may update these Terms or the Service from time to time. If we make material changes, we will provide reasonable notice (e.g., email or in‑service notice). Changes apply prospectively as of the effective date. Your continued use after the effective date constitutes acceptance.
18) Miscellaneous
No waiver. A failure to enforce a provision is not a waiver.
Severability. If any provision is unenforceable, the remainder remains in effect.
Assignment. You may not assign your rights or obligations without our consent. We may assign as part of a reorganization, merger, or sale.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Entire agreement. These Terms (and policies linked here) are the entire agreement between you and Voice 360 regarding the Service.
